Terms & Conditions — Avitus OS

These Terms & Conditions ("Terms") govern your access to and use of Avitus OS (the "Service"), provided by ABC Growth Experts ("we", "us", "our"), based in Nairobi, Kenya. By creating an account or using the Service, you agree to these Terms.

1. The Service

Avitus OS is a booking, reminder, and business management system for appointment-based businesses. Features available to your account depend on your subscription plan (Starter, Professional, or Professional Plus).

2. Your Account

You're responsible for keeping your login credentials confidential.
You're responsible for the accuracy of the business, staff, and customer information you enter into the Service.
You must be authorized to act on behalf of the business you register.

3. Subscriptions and Billing

Plans are billed monthly. A 30-day free trial is available for new accounts.
Payments are processed via M-Pesa. You authorize us to charge your chosen payment method for recurring subscription fees.
You may upgrade, downgrade, or cancel your plan at any time from your Portal. No refunds are provided for partial billing periods unless required by law.
Message limits (SMS/WhatsApp) are set per plan. Additional usage beyond your plan's limit may require an upgrade.

4. Customer Messaging

Avitus OS sends automated messages (reminders, confirmations, and follow-ups) to your customers via WhatsApp and SMS on your behalf. You're responsible for ensuring you have the right to contact your customers using the phone numbers you enter into the system, and for complying with applicable consumer protection and communications laws.

5. Data You Provide

You retain ownership of the business, staff, and customer data you enter into Avitus OS. We process this data to provide the Service, as described in our Privacy Policy.

6. Acceptable Use

You agree not to use Avitus OS to send unsolicited or unlawful messages, to store data you don't have the right to store, or to attempt to access another business's account or data without authorization.

7. Service Availability

We aim to keep Avitus OS available and reliable, but we don't guarantee uninterrupted access. Scheduled maintenance, third-party outages (such as WhatsApp, SMS gateways, or M-Pesa), or circumstances outside our control may occasionally affect availability.

8. Limitation of Liability

To the extent permitted by law, ABC Growth Experts is not liable for indirect, incidental, or consequential damages arising from your use of Avitus OS, including lost revenue from missed appointments, undelivered messages, or third-party service interruptions.

9. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these Terms, engage in abusive use of the messaging system, or fail to pay applicable fees.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
